MuscleKeep

These Terms of Use ("Terms") govern your use of the mobile application MuscleKeep (the "App"), developed and operated by an individual developer ("we," "us," or "the developer"). By downloading or using the App, you agree to these Terms.

1. Acceptance of Terms

These Terms apply to all use of the App. If you do not agree, please do not use the App.

2. Eligibility

You must be at least 18 years old to use the App. The App is intended for adults managing their own health and is distributed in the United States only.

3. Medical Disclaimer — Please Read Carefully

MuscleKeep is not a medical device and does not provide medical advice. The App's daily score is a behavioral indicator based on the habits you log (protein intake, strength training, symptom check-ins) — it is not a measurement of your muscle mass and does not diagnose, treat, cure, or prevent any medical condition. The App never tells you to increase, decrease, start, or stop any medication or dosage, and never recommends a specific drug. If the App flags a symptom pattern that may need attention, it will suggest you contact a licensed healthcare provider — it does not replace one. Always consult your physician before making any decisions about your medication, diet, or exercise. If you are experiencing a medical emergency, call 911 or your local emergency number immediately.

4. Subscription (MuscleKeep Premium)

Core tracking features (logging protein, weight, symptoms, injections, and workouts) are free and unlimited, with no paywall, indefinitely.
MuscleKeep Premium unlocks additional features for $14.99/month or $99/year, each with a 1-month free trial.
Pricing and payment are processed through the Apple App Store. The prices shown in the App Store at the time of purchase are authoritative.
Auto-renewing subscription: Your free trial begins immediately when you confirm purchase. Payment is charged to your Apple Account when the free trial ends, unless you cancel at least 24 hours before the trial ends (no charge if you cancel in time). After the trial, your subscription automatically renews and your account will be charged for renewal within 24 hours prior to the end of each billing period, unless auto-renew is turned off at least 24 hours before the period ends. You can manage or cancel your subscription at any time in your Apple ID account settings. Any unused portion of a free trial period will be forfeited if you purchase a subscription during the trial.

5. Prohibited Uses

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms
Attempt to reverse-engineer, decompile, or modify the App
Interfere with or disrupt the operation of the App
Use the App to provide medical advice or guidance to others
Misrepresent your identity or attempt to access another user's account or data

6. Availability and Changes to the Service

We may suspend, limit, or discontinue all or part of the App at any time, including for maintenance, technical issues, or reasons beyond our control, without prior notice.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE APP, EXCEPT IN CASES OF WILLFUL MISCONDUCT OR GROSS NEGLIGENCE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

10. Privacy

Your use of the App is also governed by our Privacy Policy.

11. Apple End User License Agreement

To the extent these Terms are less restrictive than, or otherwise conflict with, Apple's standard Licensed Application End User License Agreement (the "Apple EULA," available at apple.com/legal/internet-services/itunes/dev/stdeula), the terms of the Apple EULA will apply. Apple is not responsible for the App or its content and has no obligation to furnish maintenance or support. Apple is a third-party beneficiary of these Terms and may enforce them against you.

12. Governing Law

These Terms shall be governed by the laws of Japan, the jurisdiction where the developer is based.
Any dispute arising from the App may be brought in the courts having jurisdiction over the developer's location, without prejudice to any other forum available to you by law.
Nothing in these Terms limits any non-waivable rights you have under the consumer protection laws of your state of residence.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

13. Account Suspension

We may suspend or terminate your access to the App if we reasonably believe you have violated these Terms, including the Prohibited Uses listed above.

14. Intellectual Property

The App, including its design, code, and content, is owned by the developer and protected by intellectual property laws. Data you enter into the App (your tracking history, logs, and entries) remains yours.
